Flytipper goes to jail

A man found guilty of flytipping was sentenced to a day in jail by Worthing
Magistrates court this week (22/12/08) following a successful prosecution
by Adur District Council.
David McCullough, 40, of Winton Place Worthing pleaded guilty to two charges of dumping waste at Elm Grove, Lancing and the Cloverleaf roundabout in Shoreham during May and June 2007.
Members of the public and the police were instrumental in bringing this case to court. An early tip-off reported to the council led to a full investigation by council workers from several departments, including a refuse wagon crew who spotted the vehicle on their round. One of the vehicles used by McCullough was subsequently seized by the council during the investigation.
McCullough has a history of unpaid fines and because of a disability the court heard he would be unsuitable for community service.
Adur Council’s Environmental Health Manager, Gary Cushing said: "We were disappointed by the sentence Mr McCullough received because of the limited sentencing options available to the magistrates in his particular circumstances. However, the fact he received any jail time shows the authorities do take environmental offences seriously."
"The co-operation of residents in Adur and Worthing is very important in bringing these cases to court and ensuring we continue to protect the environment in which we live and work."
The council takes environmental crimes like flytipping seriously and is asking the public to report any incidents they see, they can do so confidentially by calling 01273 263331.
Householders can help prevent flytipping by making sure they use a registered waste carrier who will dispose of waste legally. A list of these can be found on the Environment Agency website www.environment-agency.gov.uk
